Diandra's lawyers claim that the couples 2000 divorce agreement gives her a piece of any income generated by projects the actor completed whilst they were married and is entitled to 50 per cent of the earnings Michael makes from any spinoffs to his previous films.

"It's the same character, the same title, just years later," Luker's attorney, Nancy Chemtob, told Manhattan Supreme Court Justice Matthew Cooper.

"Wall Street: Money Never Sleeps," directed by Oliver Stone, features Douglas in the role that he originally made famous in 1987 with the catchphrase "greed is good" fitting perfectly into the money hungry eighties decade. The film earned huge profits and reiterated Douglas' Hollywood star status.

The sequel opens mid September but it is not known how much Douglas will be paid for his role opposite fellow actor, Shia LaBeouf.

Michael Douglas, 65, who married actress Catherine Zeta-Jones, after his highly publicised split from Luker in 2000, paid his ex-wife a reported $45 million in the settlement.

The deal came after a very bitter divorce, which included accusations that Douglas was a sex addict who constantly cheated on his wife of 23 years.

Douglas is said to be furious with his former spouse. His lawyer, Marilyn Chinitz, has said the lawsuit should be dismissed and Diandra should stop trying to squeeze her famous ex.

"He doesn't want her to be an albatross around his neck forever," Chinitz said.

Justice Cooper has advised the lawyers that he hasn't yet come to a conclusion regarding the case and he will not until he decides whether it should go ahead in New York or be sent back to Santa Barbara, California, where the former couple divorced.

The embittered pair were forced to reunite recently in anguish over their son, Cameron Douglas’ recent arrest and imprisonment for drugs.

Douglas wrote a letter to the judge at the time, admitting he hadn't been a good father and also saying Diandra was "a young mother without any parenting skills handed down from her own parents." She couldn’t have been pleased with that.
